Vehicle Embargo Cases in Ecuador Are Already Near 2025 Levels

Ecuador recorded 12,322 judicial processes related to vehicle embargoes in 2025, and the number for January through May 2026 was already 10,609.

The cases are tied to unpaid auto loans backed by a pledge or title-reservation guarantee.

Where Cases Are Concentrated

Of the January-May 2026 total, 47.6% were concentrated in Guayas and 18.05% in Pichincha.

Unpaid vehicle credit can lead to late interest, contractual charges, credit-bureau damage, collection efforts, court claims, execution of the guarantee, removal of the vehicle and auction of the asset.

A Legal Protection Some Borrowers May Not Know

Ecuador's law on housing and vehicle credits includes a protection for certain auto borrowers.

The rule can allow the debt to be fully extinguished by handing over the vehicle or executing the guarantee when the vehicle is the borrower's only personal or family-use vehicle, the original loan amount does not exceed 100 unified basic salaries, and the financing has a pledge or title-reservation guarantee.

For 2026, that 100-salary limit is listed as $48,200, using Ecuador's $482 basic salary.

When the conditions are met, delivery of the car extinguishes the obligation, including capital, interest, surcharges, fines and legal expenses.

What This Means for Expats

If you are financing a car in Ecuador, the paperwork matters. The risk depends on the credit contract, the guarantee structure and how quickly a borrower responds when payments become difficult.

Before signing, understand whether the contract includes a pledge, title reservation or other guarantee. If payments are already behind, getting advice early can matter more than waiting until the case reaches execution.
